What is a heritable building right?
A heritable building right is the right to erect and/or maintain a building on a plot of land in return for payment of a regular ground rent (Section 1 (1) Erbbaurechtsge-setz). From the perspective of the owner of the property (the leasehold owner), the leasehold is a limited right in rem that is encumbered on his property.
The leasehold is created by a leasehold contract between the leaseholder and the landowner. The heritable building right itself is treated like a plot of land (a right equivalent to a plot of land). The leasehold can be sold, inherited and encumbered like a plot of land, for example with liens (land charge and mortgage). It is therefore entered in a separate land register sheet, the so-called heritable building right land register. The leasehold expires at the end of the agreed period (in this case 99 years).
